1. Acceptance of Terms
By using ViralMint ("the Software"), you agree to these Terms of Service. If you do not agree, do not use the Software.
2. Description of Service
ViralMint is a desktop application for content creators that provides video scouting, analysis, generation, and publishing tools. The Software runs locally on your computer and optionally connects to cloud services for additional features.
3. License
The ViralMint desktop application is released under the MIT License. You are free to use, modify, and distribute the software for personal and commercial purposes, subject to the terms of the MIT License.
4. User Responsibilities
You are responsible for:
- Content compliance — ensuring that content you create, download, and upload complies with applicable laws and platform terms of service
- Copyright — respecting copyright and intellectual property rights when downloading and analyzing competitor videos
- Platform terms — complying with YouTube, TikTok, and other platform terms when uploading content
- API usage — using third-party APIs (AI providers, video platforms) within their usage policies
- Account security — keeping your API keys, OAuth tokens, and account credentials secure
5. Acceptable Use
You agree not to use ViralMint to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Create or distribute harmful, misleading, or deceptive content
- Circumvent platform rate limits or access restrictions in a way that violates platform terms
- Distribute malware or engage in unauthorized access to systems
- Harass, abuse, or harm others
6. Cloud Services (Optional)
If you create a ViralMint account to access cloud features:
- Free tier — includes basic AI chat and shared API key access, subject to rate limits
- Paid subscriptions — provide higher limits and premium features, billed monthly or annually through Stripe
- Cancellation — you may cancel your subscription at any time through your account settings. Access continues until the end of the billing period.
- Refunds — subscription fees are non-refundable except where required by law
7. Third-Party Services
ViralMint integrates with third-party services (AI providers, video platforms, payment processors). Your use of these services is governed by their respective terms and policies. We are not responsible for third-party service availability, pricing changes, or policy changes.
8. Intellectual Property
Content you create using ViralMint belongs to you. The ViralMint name, logo, and branding are trademarks of ViralMint. The software source code is licensed under the MIT License.
9. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
10. Limitation of Liability
To the maximum extent permitted by law, ViralMint and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or revenue, arising from your use of the Software.
11. Changes to Terms
We may update these terms from time to time. Continued use of the Software after changes constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by applicable law. Any disputes shall be resolved in the jurisdiction where the service provider is located.
